Terms of Use
1. About these terms
QECheck ("QECheck", "we", "us", "our") is operated by Hayley Chin. These Terms of Use ("Terms") govern your access to and use of the QECheck website and tools at qecheck.com (the "Service").
By using the Service, you agree to these Terms. If you use the Service on behalf of a business, you confirm you are authorised to accept these Terms for that business.
2. What QECheck is — and isn't
QECheck is an information and calculation aid for Australian employers, bookkeepers and payroll professionals. It can reconcile expected versus recorded super, classify pay codes against the ATO's qualifying-earnings rules, estimate Payday Super due dates, and split super-inclusive packages.
QECheck is not, and must not be relied on as:
- legal, taxation, accounting, superannuation or financial advice;
- a tax agent, BAS agent or financial-adviser service;
- a substitute for the Australian Taxation Office (ATO), the relevant legislation, your fund, your software, or your own qualified adviser.
Results are general in nature, are based on rules and rates as we understand them at the time, and may not reflect your specific circumstances. The ATO and the applicable law are always the authority.
3. No professional relationship
Using the Service does not create any professional, advisory, fiduciary or client relationship between you and us.
4. Accuracy and "as is" availability
We try to keep QECheck accurate and up to date, but superannuation rates, thresholds, due-date rules and pay-code classifications change and can be interpreted differently in different situations.
The Service is provided on an "as is" and "as available" basis. We do not warrant that it will be accurate, complete, current, uninterrupted or error-free. You must independently verify any result — including calculations, pay-code classifications and due dates — before you rely on it or make any payment or compliance decision.
5. Your responsibilities
You are solely responsible for:
- your superannuation guarantee obligations, payments, timing and reporting;
- checking QECheck's outputs against the ATO, the relevant legislation, your fund and your adviser;
- the accuracy of any data you enter; and
- your use of the Service in line with these Terms and applicable law.
6. Acceptable use
You agree not to:
- use the Service for any unlawful purpose;
- rely on the Service as your sole basis for a super, tax or payroll decision;
- attempt to interfere with, disrupt, scrape at scale, reverse engineer or gain unauthorised access to the Service; or
- misrepresent the Service as endorsed by, or affiliated with, the ATO or any government body (it is not).
7. Intellectual property
The Service, including its design, text, classification rules, code and branding, is owned by us or our licensors and is protected by law. We grant you a personal, revocable, non-exclusive licence to use the Service for its intended purpose. You may share links to QECheck; you may not copy, resell or create a competing product from our content without our permission.
8. Privacy and your data
Your payroll and YTD files are parsed and processed in your browser. We do not upload, receive or store your payroll or YTD files, row-level payroll data, or YTD superable earnings data. Our handling of the limited information we do collect (such as basic usage analytics and any feedback you email us) is described in our Privacy Policy, which forms part of these Terms.
9. Third-party services and links
The Service may use third-party tools (for example, analytics and hosting providers) and may link to third-party sites such as the ATO. We are not responsible for the content, accuracy or practices of third parties.
10. Disclaimers and limitation of liability
Australian Consumer Law. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law (ACL) or other law that cannot lawfully be excluded. Where our liability for breach of a non-excludable guarantee can be limited, it is limited, at our option, to re-supplying the relevant service or paying the cost of having it re-supplied.
Otherwise, to the maximum extent permitted by law, and because the Service is provided free of charge:
- we exclude all other warranties, express or implied;
- we are not liable for any direct, indirect, incidental, special or consequential loss or damage arising from your use of, or reliance on, the Service — including any error in a calculation, classification or due date, any superannuation shortfall, the Superannuation Guarantee Charge, interest, penalties, or any business, financial or data loss; and
- where we are found liable despite the above, our total aggregate liability is limited to AUD $100.
11. Indemnity
To the extent permitted by law, you agree to indemnify us against any claim, loss or cost arising from your breach of these Terms or your misuse of the Service.
12. Changes
We may update, suspend or discontinue the Service or these Terms at any time. Changes take effect when posted here. Your continued use after a change means you accept the updated Terms.
